Sales Tax... Sales tax will be collected at 7.5% for this auction per Ohio requirements. If you carry a tax exempt status, you must submit and verify receipt of your tax exempt form to our office prior to auction end. Forms not received prior to auction end will be applied to future purchases however, tax will be collected for purchases prior to receipt of such form and you will need to apply to the state for a refund of the tax amount charged.
The bidding closes the first item at posted auction closing time, then closes 3 items per minute thereafter until the last item ends, in catalog order. NOTE: We strongly urge you to use the "max bid" feature. Occasionally there will be a lag time between your watch list and the actual auction page. By submitting your max bid, you will ensure that only someone willing to pay more for the item than you is able to overbid you.
REMOVAL...This is an ONLINE ONLY AUCTION. Removal date is specified on auction page, please contact our office if you will require shipping or additional time to pick up your item(s). REGARDLESS of when the item is removed, payment for your invoice MUST be received the day after the auction ends. Additionally, a $5.00 per day, per invoice storage fee will be instated beginning the 15th day after the auction ends... NO EXCEPTIONS.
NO refunds or charge backs will be granted due to a lack of removal at the designated times. After the scheduled removal, items will be considered abandoned after 14 days and you will be charged a removal fee to dispose of your items. If you require shipping and/or storage please make arrangements as soon as possible after the auction ends. If you have won items and we are not able to reach you to arrange payment, the credit card you have on file with us will be charged.
BUYERS PREMIUM... A 15% buyer's premium will be added to each purchase. If you bid $100.00, at check out you will be charged $115.00.
PAYMENT... Accepted forms of payment include Visa, MasterCard, Discover, Cash, Certified Check, Money Order. If you are paying cash, cashiers check, or bank wire transfer, please make arrangements with our office at 205-620-3736. Otherwise your credit card on file will be charged at the end of pick-up day. We require payment within 24hrs of auction closing regardless of auction location or shuttle times.
Registered bidders MUST have available funds on their credit cards to cover all items purchased. You must contact us by the end of pick-up day if you plan on using an alternate card. If your credit card declines, you will be assessed a 2% fee for rerunning the card.
WAREHOUSE SHUTTLE & SHIPPING: We can ship items to you, so please make arrangements on auction pick up day. If you need additional days to pick up, let us know on pick up day and if we can accommodate you, we will.
Increasing your own bid / bidding errors... Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. You should immediately review your bids once submitted. If you mistakenly increase your own bid, place your bidder number in the bid field, or make a typo you must immediately contact our office by phone or email use the contact sheet on our website (we must have your request in writing, even if you call). We will not reverse bids after the auction has closed - NO exceptions.
Staggered Closing... Our online auctions generally close 3 items per minute (ex: items 1, 2 and 3 end at 7:00, items 4, 5 and 6 end at 7:01, and so on). This feature will close the bidding at intervals, which works great with the auto-extend feature to closely emulate a 'live' auction.
Dynamic Closing... The closing time of an item or lot is automatically extended an additional 3 minutes whenever a bid is placed within the last 3 minutes of the item's closing time.
Bid Notification... To quickly review your bids and see if you are winning or have won you can utilize the 'review bids' feature (found under "My Account"). Any items that you have been outbid on will be clearly marked.
Winning Bidder Notification... You will be contacted by email ONLY (you are responsible for checking your email). If you feel you have won an item yet have not received an email, you must notify us by email no later than 9:00 am the next day. In the event an item is not available for pickup, the buyer must notify our onsite staff and file a claim by replying to your original emailed invoice noting what was not available within 24 hours of the pickup date. After 24 hours, the Auctioneer and buyer agrees that no adjustment or refund will be made.
IMPORTANT TAX EXEMPT STATUS... If you are tax exempt, prior to the conclusion of the online auction you must email a copy of your state's tax exempt form to info@samlilly.com. (You must include your bidder number and the closing date of the auction). Forms without this information will not be accepted. If you have any questions call 205-620-3736.
CAUTION... For demonstration purposes various equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.
Catalog Inaccuracies... You are bidding on the described item, not the photo. Rarely does an error in photo insertion occur; however, always read the item description.
WARRANTY & CONDITION OF ITEMS SOLD... All items are sold "AS-IS, WHERE-IS", with NO WARRANTY expressed or implied by the lot number affixed to the item. Keep in mind that many of these items are restaurant worn and have been nailed to the wall in some cases. Descriptions are believed to be accurate but are not guaranteed. When you are not certain of the condition or use of an item please bid accordingly. You are bidding on the described item, not the photo. Bidders are responsible for their own removal. Any item NOT picked up by the allotted time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid email receipt. Please ensure that movers or anyone picking up items on your behalf have your paid receipt at the pickup location - no items will be released without a paid email receipt.
IMPORTANT!... The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchase, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection, transportation and storage expenses associated with delinquent accounts or abandoned items.
DAMAGE... Any damage caused by a buyer during the preview or removal must be made good by the buyer causing the damage. Buyer agrees that the credit card on file will be charged for any expenses and/or repairs to the pick-up location of property of another buyer. Items damaged by buyer during removal will not be refunded.
RELEASE OF LIABILITY... Sam Lilly Liquidators is not liable nor responsible for any bodily injuries, death to any persons or any damages to property when removing or transporting any items; your acceptance of these terms when bidding acknowledges this release of liability.
CHOOSE WISELY... We want every one to get a good deal and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. The auctioneer reserves the right to add or remove items from the auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend, or reschedule an individual item and/or auction event, as well as make changes to the auction closing times or inspection or removal times.
Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Shelby County, Alabama. Liability: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price only.
LIMITATIONS... The above-stated Conditions of Sale cannot be altered except in writing by The Auctioneer.
